2. Response to Copyright Claims
Upon receiving a valid DMCA notice, Cvahost will:
- Investigate the complaint and remove or disable access to the infringing content if necessary.
- Notify the user responsible for the content about the takedown request.
- Allow the user to submit a counter-notification if they believe the content was removed by mistake.
3. Submitting a Counter-Notification
If you believe your content was removed due to an error or misidentification, you may submit a counter-notification to Cvahost’s DMCA Agent. The counter-notification must include:
- Identification of the removed material and its previous location on Cvahost.
- A statement, under penalty of perjury, that you have a good faith belief that the material was removed due to mistake or misidentification.
- Your name, address, email, and phone number.
- A statement consenting to the jurisdiction of the applicable courts in India and your agreement to accept service of process from the original complaining party.
- Your physical or electronic signature.
Upon receiving a valid counter-notification, Cvahost may restore the content unless the original complainant files legal action within 10 business days.
4. Repeat Infringers
Cvahost reserves the right to terminate accounts of users who repeatedly violate copyright laws or fail to comply with DMCA notices.
5. Misrepresentations
Knowingly submitting false copyright claims or counter-notifications may result in legal liability. Cvahost reserves the right to take appropriate action against fraudulent claims.
